OKLAHOMA SCRAP TIRE BRIEFING SHEET

STATE REGULATIONS
Oklahoma Waste Tire Recycling Act implemented July 1, 1989, charges $1 per tire surcharge on new tire sales. Monies deposited in the Waste Tire Indemnity Fund are used as an incentive to help eliminate existing stock piles of tires and to promote recycling of waste tires by reimbursing facilities that process scrap tires.

The reimbursement program is broken into two distinct categories, the categories and the requirements to qualify for each of them are listed:

OSDH permitted waste tire processing facilities are eligible for reimbursement at a rate of $0.50/tire, if they demonstrate that 25% of the tires their facility processes are from OSDH designated illegal tire dumps.
OSDH permitted waste tire processing facilities are eligible for an additional $0.35/tire reimbursement, if they demonstrate their facility is providing pickup and transportation of waste tires from each county of the state on a regular basis.

SB 832 (1994) added accountability and audit requirements to the scrap tire program.

HB 1387 (1995) expanded the fee to original equipment tires and to larger tires, established a manifest system for scrap tire shipments, assists recycles and TDF users to recover capital costs, and improved other program features.

Establishes a civil penalty of up to $500 per waste tire for improper transport.

In 2002, the law was amended to mandate that all retailers must now participate in the state program. Manufacturers remain exempt from the program.

MAJOR MARKETS
Municipal landfills use waste tire chips as drainage layers. Residential septic systems installers use waste chips in absorption. Three cement kilns burn TDF.
