OHIO SCRAP TIRE BRIEFING SHEET

STATE REGULATIONS
House Bill 592, the State Solid Waste law became effective in June 1988 and defines waste tires as a solid waste. Senate Bill 165, the State Scrap Tire became effective in October 1993, substituted the term scrap tire, and established comprehensive structure for regulating scrap tire collection storage, recovery, monofill and monocell facilities and scrap tire transporters. A $0.50/fee was placed on each new tire sold at the wholesale level and the funds from this fee are designated for stock pile abatement, grants and loans to scrap tire facilities program administration, and research at the University of Akron:

Regulations to implement Senate Bill 165 were adpote and became effective in March 1996. The regulations require:

o effective March 1, 1996 the ban of all whole tires from solid waste landfills;
o effective March 1, 1996 the ban of all cut and shredded tires from solid waste landfills;
o tires will only be accepted at licensed scrap tire facilities, (collection, storage, recovery, monofill, or monocell);
o all scrap tire transporters, picking up or delivering scrap tires in Ohio, must be register with the Ohio EPA;
o Tire monofills require liners, leachate collection, weekly cover, and final cap.

Prohibits transport of waste tires for disposal to any location in the state other than a municipal landfill in compliance with this law.

HB25 is estimated to generate between $750,000 and $850,000 revenues annually. The Tire Recycling Fund has had no source of revenue since the tire recycling fee was redirected to the Highway Infrastructure Fund in 1999.

MAJOR MARKETS
Redland Lime Kilns completed test burns in January 1997 and are awaiting issuarnce of a Permit-to-Operate. Southwest Portland Cement has a permit to burn TDF, but is not currently burning and TDF. Ohio Edison is considering the use of TDF at two facilities. Several solid waste landfills are planning to beneficially use tire chips as the drainage layer for their leachate collection system during new cell construction 1997 and 1998.
