NORTH DAKOTA SCRAP TIRE BRIEFING SHEET

STATE REGULATIONS
As of December 31, 1992, the state's Solid Waste Management rules on scrap tires became effective. Requirements for storage of scrap tires include:

o control access to the tire pile by fencing;
o limit the tire pile to a maximum of ten thousand square feet in size;
o limit the height of the tire pile to 20 feet;
o provide for a 50 foot fire lane around the tire pile;
o provide site access by fire control equipment;
o provide run-on and run-off control system adequate to control surface water from a 225 year, 24 hour precipitation event;
o additional rules apply if the site has more than one pile;
o scrap tire haulers must be licensed;
o allows landfills to accept tires and to co-mingle with municipal solid waste;
o tire piles in excess of 800 scrap tires must have a permit;

Prohibits transport of waste tires for storage to any location in the state other than a permitted or authorized waste tire storage site.

MAJOR MARKETS
The majority (about 56%) of the state's scrap tires are landfilled; some are processed and sent to coal-fired utilities in South Dakota for TDF. Some use for engineering purposes, including landfill drainage layers.
