MISSISSIPPI SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
SB 2985 (1991) established a $1 per tire fee on retail sales of tires that
began in January 1992. Twenty five cents of each dollar collected will be placed
in a grant fund for counties and cities to help fund scrap tire management programs.
Waste tire transportation regulations became effective in 1992 and include these requirements:
Effective January 1, 1992 waste tire haulers and transporters must be registered and hauler/collectors, generators, and processors must maintain manifest records of number of tires generated from a facility, transported, processed, reused or disposed. A permit must be obtained if a facility stores more than 500 scrap tires or 100 scrap tires for more than 90 days. Scrap tires can still be landfilled, but must be processed.
Waste tire grant regulations became effective July 1, 1992. The regulations address the eligibility and allocation of funds from the Environmental Protection Trust Fund which receives revenues generated by the $1/tire fee on new tire sales. Under the regulations, counties and regional solid waste disposal authorities are eligible for 50% of the monies in the fund for planning and storage, processing and/or disposal waste. The remaining 50% is allocated for manufacturing incentive grants, research and demonstration projects, pile abatement and fund administration.
SB 2751 (1995) continued fee to 2001. Allows possible landfill ban in 1998. Provides greater flexibility in use of cleanup and grant funds. The fee has since been extended and tires with rim diameters of more than 24 inches are subject to a $2.00 fee.
Allows permit or authorization to be suspended, revoked, or denied renewal for failure to comply with regulations. Allows declaration of a public health or safety emergency based on potential fire hazard, threat of insect-borne disease or potential ground or surface water contamination, triggering removal and proper disposal of the tires.
MAJOR MARKETS
Potential markets exist with the Georgia Pacific pulp and paper mill and
Holnam Cement kiln interested in TDF. A large ground rubber producer is located
in state, as well as two pulp and paper mills.
