GEORGIA SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
H.B. 1385 (1992) amended the state solid waste act. The law which became
effective July 1, 1992 includes:
o A $1 per tire management fee on the sale of new passenger and truck tires.
Monies generated are to be used for grants/loans to cities and counties for
pile abatement and enforcement, and for innovative technology development;
o A requirement that generators of scrap tires obtain an identification number;
o A requirement for carriers to obtain permits, including financial assurance;
o The establishment of a manifest/tracking system for scrap tires; and
o A ban on whole tires from landfills effective January 1, 1995. Shredded or
chopped tires can be landfilled if no other end markets are available.
Effective January 1, 1993, guidelines were implemented by the Board of Natural Resources that includes:
o That accurate records must be kept and reported to the Environmental Protection
Division (EPD) by retail dealers, generators, haulers and processors;
o That scrap tires must be properly manifested to approved EPD end users, processors,
or disposal facilities; and
o Provides criteria for the storage of scrap tires and processors of scrap tires.
In 2004, an initiative to siphon funds from the scrap tire account to the general fund, was proposed. The Solid Waste Trust Fund was nearly fully funded during the 2006 budget year, after a number of years of being under funded or completely unfunded. The state retail tire fee is set to be reauthorized during the 2008 legislative session.
MAJOR MARKETS
One cement kiln currently uses TDF as a supplemental fuel, and three processors
produce ground rubber. Tire chips are allowed and being used as back fill for
septic system leach fields.
