STATE REGULATIONS
The Solid Waste Act of 1988 requires a $1/tire tax on the retail sale of
tires and also requires tires to be cut prior to landfilling. The law further
stipulates:
o waste tire sites must be closed or located at a permitted facility;
o processing or disposal facilities must be under permit;
o small processing facilities, collection centers and mobile processors must
have a general permit;
o waste tire collectors must be registered;
Section 62-711 of the state administrative code contains the rules for storage, collection and processing tires.
Chapter 62-716 deals with state tire grants and requires annual reports by grant recipients.
Legislation enacted in 1995 expanded allowable use of county waste tire grants. Counties under 100,000 population can use waste tire grants for any solid waste related purpose. In the last several years, these grants have been expanded to include counti

Ground rubber producers in the state sell playground and sports surfaces;
soil amendments and mulch; and molded rubber products accountting for the use
of 34,400 tons of tires. The Florida Department of Transportation specifies
rubber-modified asphalt in high speed state roads, and crumb rubber from 15,000
tons of tires is used annually for state projects. In-state industries use about
52,000 tons of TDF in power plants and cement kilns, and waste to energy plants
use 13,500 tons of tires per year, while out-of-state energy users account for
24,200 tons of TDF from Florida.
Tire chips in drainage and gas collection layers at landfills; as substitute landfill daily cover; and septic tank drainfield applications account for another 24,800 tons of tire use. Export of used tires approximates 2,500 tons.
