STATE REGULATIONS
Act 748 (1991) established 30 percent income tax credit for equipment used
to reduce, reuse or recycle solid waste.
Act 749 (1991) is a comprehensive recycling measure. Whole tires are banned from landfills. The act mandates creation of licensing or permit requirements for scrap tire transporters, collection centers and processing facilities; imposes a $1.50 per tire disposal fee on tires sold at retail; and gives a 10% preference for retread purchase for state vehicles. Moneys derived are placed in a dedicated fund for a scrap tire recycling and grant program. Regulations promulgated in 1992.
Act 752 (1991) establishes regional solid waste management authorities and requires that regional authorities provide collection centers for tires.
Act 518 (1993) increases the number of tires that can be stored at collection centers to 3000 loose or 10,000 baled.
Act 519 (1993) requires the establishment of a scrap tire manifest system.
Act 529 (1993) exempts imported scrap tires going to a waste processing facility from the $1 fee on imports going to disposal facilities. The PCE Commission must approve exemptions.
Act 1315 (1995) requires retailers to accept, without charge, a scrap tire for each tire purchased; collection centers are required to accept auto, truck and specialty tires at no charge if a waste tire fee was collected at the time of sale.
Act 1292 (1997) increases the per tire disposal fee from $1.50 to $1.75. It also allows each regional solid waste management district to assess a separate fee on truck tires of no more than $4.00, and it mandates additional reporting requirements for tire retailers.
Licenses are required for transporters (of more than 25 tires per load), and permits are required for collection centers and processing facilities. Current regulations provide that tires that have been cut, sliced or otherwise reduced may be landfilled.
MAJOR MARKETS
One cement plant uses TDF as a supplemental fuel.
Two monofills are currently operating. Other markets include the production of playground cover, rubber mulch, aggregate for septic systems, and shreds for landfill leachate systems.
