ARIZONA SCRAP TIRE BRIEFING SHEET
STATE REGULATIONS
The Waste Tire Disposal Statute A.R.S§.44-1301 established a 2% tire
fee on the sale of all new tires (not to exceed $2.00 per tire). Major components
of the law include:
o If the manufacture of a vehicle does not specify the separate cost of the
tires, the wholesaler or retailer of the vehicles sold shall collect a fee not
to exceed one-half the maximum fee for vehicles under ten thousand pounds;
o The retail sellers are required to accept waste tires from customers at the
point of transfer;
o Waste tire collection sites must register with the Department of Environmental
Quality;
o No tires can be disposed at the landfills without first shredding the tires;
o Bans disposal of whole tires;
o Establishes acceptable methods of waste tire disposal including retreading,
chopping or shredding, incinerating or using as a fuel or pyrolysis if permitted
by laws, regulations or ordinances relating to burning, hauling to a processing
facility;
o Establishes a waste tire grant fund managed by the department of revenue;
o Waste tire fund monies are distributed to the counties based on their pro
rata share of registered vehicles in that county;
o Each county must have a waste tire management program and at least one waste
tire collection site; and
o ADEQ's role is one of administration and enforcement of waste tire collection
sites for compliance to their approved plan.
A.R.S. Title 44. Ch. 9, Art. 8, was amended in 1994 to revise portions of the scrap tire program and establish a joint legislative committee to study the program and make recommendations for improvements including increasing markets. In 1997 the program was contained, with the counties responsible for tire management.
MAJOR MARKETS
One ground rubber facility with capacity of five million tires annually.
Arizona is the state in which the wet process for rubber modified asphalt was
developed and it continues to be a major user of rubber-modified asphalt.
